Bankruptcy, Reorganization and Creditors' Rights

Safeguarding Clients Intersecting with Bankruptcy

Protecting and improving our clients' collateral and positions are the mainstay of our practice in bankruptcy, reorganization and creditors' rights.

Representation of bondholders, bond issuers and financial lending institutions asserting their rights in bankruptcy proceedings is a significant emphasis of our counsel. We also regularly manage complex litigation including the defense of bankruptcy-related class actions.

Our attorneys' experience includes some of the largest bankruptcies in Louisiana and multiple casino and gaming insolvencies. We counsel secured and unsecured creditors, trustees, and creditors' committees.

Additionally, lawyers counsel on specialized foreclosures for a range of clients, including maritime financiers and manufacturers of heavy equipment and vehicles.

Practice Scope

McGlinchey Stafford attorneys guide clients during all stages of the insolvency process. We apply initial mechanisms to cease further risks, and inject a practical, business-minded perspective throughout negotiations, hearings and in court.

Knowledge of a client's business and industry often proves advantageous when structuring reorganization and workout plans. We leverage all our firm's strengths in business and litigation across multiple industries so that clients can better leverage their assets.

Our legal team is led by board certified business bankruptcy attorneys and specialists. We are recognized as Best Lawyers in the field and are active leaders and participants in the American Bankruptcy Institute, American College of Bankruptcy and other professional associations.
